Aged Dependent Relative Visa (Subclasses 114/838)

Overview

These visas allow you to live and settle in Australia if you are the relative of an Australian citizen, permanent resident, or eligible New Zealand citizen, whom you rely on for financial support.

Both are permanent visas. The subclass 114 visa is for applicants who are outside Australia, whilst the 838 visa is for applicants who are inside Australia.

What You Can Do & How Long You Can Stay

Both these visas are permanent visas.
You can travel to and from Australia multiple times.
You can live, work and study in Australia whilst on this visa.
You can access Medicare whilst on this visa.
You can include your dependent child in your application.
You may be eligible for a Bridging Visa to remain in Australia while waiting for the subclass 838 visa to be processed.

Limitations and Important Things to Know

You must be over the Australian Aged Pension age.
You must have no partners.
There is a substantial waiting period for these visas to be granted.
You may be refused this visa if a member of your family unit cannot meet health or character requirements, even if they are not accompanying you to Australia. This is known as the “One Fail, All Fail” rule.
Usually, you will not be eligible for a Bridging Visa to remain in Australia while waiting for the subclass 114 visa to be processed.

Be sponsored by a relative who is an Australian citizen, permanent resident or eligible New Zealand citizen, and who has lived in Australia for the last two years
Have been financially dependent on your Australian relative for at least 3 years
Be able to obtain an Assurance of Support agreeing that you will not rely on government assistance. A financial bond is required.
